Can S Pass or Work Permit holders serve as company directors or company secretaries? What are the potential consequences?
S Pass or Work Permit holders are not permitted to be shareholders or own/manage businesses in Singapore. As such, they cannot be registered as sole proprietors, partners, directors, or secretaries of any company with the Accounting and Corporate Regulatory Authority (ACRA).
If they attempt to do so, it would be a violation of their S Pass or Work Permit conditions, leading to the revocation of their work pass. Additionally, they would be subjected to an employment ban.
